INTORODUCTION This Statement is being issued to provide guidance regarding objects that display the mark, “Made By ROA”. It has been determined that objects qualified to bear the mark, “Made By ROA” must be manipulated by the All American Sculptor Ryan Roa. The claims should be substantiated by evidence that the objects are all or virtually all made by Ryan Roa. This statement is intended to elaborate on principles set by an individual to govern his process. This statement, furthermore, is the culmination of a comprehensive process in which Roa has reviewed his standard for evaluating the mark, “Made By ROA”. Throughout this process, Roa explores Walter Benjamin’s notion of “Aura”. The principles set forth in this enforcement policy statement apply to objects conceived in the mind of Ryan Roa and then translated to the viewer through his hands. Based on the review of the term "Made By ROA," and the record as a whole, it is concluded that viewers are likely to understand a the marking “Made By ROA”, to mean that an object is "all or virtually all" physically made by the All American Sculptor Ryan Roa. Therefore, when a dealer makes a claim that an object is "Made By ROA," it should, at the time be claimed so by Roa which relies upon a reasonable basis that the object is in fact all or virtually all made by the hands of Ryan Roa. An object that is all or virtually all made in the Ryan Roa will ordinarily be one in which all significant parts and processing that go into the making of the object are manipulated by the hands of Ryan Roa. In other words, where an object labeled or otherwise advertised with a "Made by ROA" claim, it is conceived by Ryan Roa, and then there after manipulated by the touch of his hands. Although there is no single "straight line" to establish when an object is or is not "all or virtually all" made by the All American Sculptor Ryan Roa, there are a number of factors looked at when making this determination. To begin with, in order for an object to be considered "all or virtually all" made by Roa, the final construction of the object must physically be made by Ryan Roa. Beyond this minimum threshold, the factors, including but not limited to the portion of the objects construction which is attributed to foreign fabrication, and how far removed from the finished object foreign fabrication is.
